Welcome to Globant University! This platform includes the various learning and career contents developed and/or published by Globant from time to time (the “Contents”).

You must know using any of our Contents, our websites and/or software applications (the “University”) or accessing any Contents available through the University, you are agreeing to comply with these terms (the “Terms”) which constitute the binding agreement between Globant, as proprietary of the Contents and provider of the University (“Globant”, “we”, “us” or “our”) and you, as user (the “User”, “you” our “your”).

You acknowledge that you have read and understood these Terms, accept these Terms, and agree to be bound by them. If you don’t agree with (or cannot comply with) these Terms, then you may not use the University.

If you violate these terms, we may terminate your use of the University, ban you from future use of the Contents, and/or take appropriate legal actions.

We may update these Terms from time to time. When we update these Terms, we will revise the “Effective Date” date above and post the new Terms and Conditions.

1. USING GLOBANT UNIVERSITY.

A. Consenting these Terms and any modification thereof.

In order to use the University, you need to be 18 or older and consent to these Terms, or be 13 or older and have your parent or guardian’s consent to these Terms.

Occasionally we may, in our discretion, make changes to these Terms. The changes to these Terms will not be retroactive, and the most current version of the Terms, which will always be at https://university.globant.com/terms-and-conditions, will govern our relationship with you. We will try to notify you of material revisions, for example via an online notification or an email to the email associated with your account. In some cases, we will notify you in advance, and your continued use of the University after the changes have been made will constitute your acceptance of the changes. Please therefore make sure you read any such notice carefully. If you do not wish to continue using the University under the new version of the Terms, you may terminate the University by contacting us to globant-university@globant.com.

B. Intellectual Property.

Using the University does not give you ownership of any intellectual property rights in the University or the Content. These terms do not grant you the right to use any branding or logos of Globant or any of those used in the University.

The contents of all material available on the University are copyrighted by Globant unless otherwise indicated. All rights are reserved and content may not be reproduced, downloaded, disseminated, or transferred, in any form or by any means, except with the prior written agreement of Globant or as indicated below.

C. Restrictions On Use.

Don’t misuse the University nor the Contents. For example, don’t interfere with the site or try to access them using a method other than the interface and the instructions that we provide. You may use the University only as permitted by law, including applicable export and re-export control laws and regulations.

You may not decompile, "reverse-engineer", disassemble, or otherwise attempt to derive the source code for the Contents.
You may download pages or Contents for your own personal use, but no part of such Content may be otherwise or subsequently reproduced, downloaded, disseminated, or transferred, in any form or by any means, except with the prior written agreement of, and with express attribution to, Globant.

You agree not to (i) deep-link to the site for any purpose, unless specifically authorized by us to do so; (ii) probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures; (iii) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the University to send altered, deceptive or false source-identifying information; or (iv) interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming or mail-bombing the University.

You may not modify the University or create any derivative work of the University and/or the Contents or its accompanying documentation. Derivative works include but are not limited to translations. You may not alter any files or libraries in any portion of the Contents. You may not reproduce the database portion or create any tables or reports relating to the database portion.

D. Restrictions on Transfer.

You may not assign your rights and obligations hereunder, or redistribute, encumber, sell, rent, lease, sublicense, or otherwise transfer your rights to use the University.

E. Member Account, Password and Security.

You will need an account to use and access the University. Your account will be assigned to you by an administrator, such as your employer or educational institution. Your administrator may be able to access or disable your account according to their own policies.
You are responsible for safeguarding your account, if a password is required, please use a strong password and limit its use to this account. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above. You are fully responsible for all activities that occur under your password or account.

2. PRIVACY.

Our Privacy (https://university.globant.com/privacy-policy) describes how we handle the information you provide to us (included any personal data) when you use the University. You understand that through your use of the University you provide Globant your freely given, specific, informed and unambiguous consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States, Ireland, and/or other countries for storage and processing as described in the Privacy Policy.

3. DISCLAIMERS AND LIMITATIONS OF LIABILITY.

A. Disclaimer of Warranties and Limitation of Liability.

SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.

Globant makes no warranty that operation of the University will be secure, error free, or free from interruption. You must determine whether the University sufficiently meets your requirements for security and uninterruptability. You bear sole responsibility and all liability for any loss incurred due to failure of the University to meet your requirements. Globant will not, under any circumstances, be responsible or liable for the loss of data on any computer or information storage device.

B. Limitation of Liability.

By using the University you agree that Globant, its parents, affiliates, related companies, officers, directors, employees, agents representatives, partners and licensors, liability is limited to the maximum extent permissible in your country of residence.

WHEN PERMITTED BY LAW, GLOBANT, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF GLOBANT, FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO USD 100 (ONE HUNDRED US DOLLARS) OR THE AMOUNT YOU PAID US TO USE THE UNIVERSITY.

IN ALL CASES, GLOBANT WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

4. GENERAL.

A. Reserved Rights.

Globant reserves the right to access, preserve and disclose your account information and content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (i) comply with legal process; (ii) enforce these Terms; (iii) respond to claims that any content violates the rights of third parties; or (iv) protect the rights, property or personal safety of Globant, its users and the public.

You further acknowledge, consent and agree that all users may take down contents of which they themselves are recipient or sender without the need to provide any justification thereof.

B. Severability.

If any provision of these Terms shall be held to be invalid or unenforceable, the remainder of these Terms shall remain in full force and effect. To the extent any express or implied restrictions are not permitted by applicable laws, these express or implied restrictions shall remain in force and effect to the maximum extent permitted by such applicable laws.

C. Ending these Terms.

You may end your legal agreement with Globant at any time by deactivating your accounts and discontinuing your use of the University.

We may suspend or terminate your account or cease providing you with all or part of the University at any time for any or no reason, including, but not limited to, if our provision of the University to you is no longer commercially viable or if we reasonably believe that you have violated these Terms.
